Educational cases on protection of elderly rights in 2021 released

Traffic accident liability disputes rank second in the number of China's civil cases involving the elderly, according to a list of cases with educational significance in 2021 on protecting the rights and interests of the elderly, which was jointly released by the China National Committee on Ageing and the China Judicial Big Data Institute on April 18.

Cases show that many elderly people use three or four-wheeled electric vehicles as their means of transportation, where vehicle registration and driver's licenses are required for legitimate driving because the weight, speed and size of these vehicles all fall into the category of motor vehicles.

However, most elderly users do not register their vehicles or obtain driver's licenses and are thus unable to obtain compulsory traffic accident liability insurance. Therefore, their rights and interests are hard to secure in the event of an accident.

Other elderly-related cases involve re-employment, tourism consumption, marriage, healthcare product fraud and telecom scams. Statistics show that labor contract disputes and healthcare tourism fraud all saw increases in recent years.

In 2021, courts across the nation concluded 542,500 cases relating to the elderly, over 90 percent of which were civil cases.
