The Central Supervision System for the Protection of Ecological Environment: Problems and Policy Options (No.203, 2018)

Abstract: Since the implementation of the central supervision system for the protection of ecological environment in January 2016, notable achievements have been made whereas there is still room for further improvement. For example: the system lacks adequate legal basis, the role of the National People’s Congress and the Discipline Inspection and Supervision Commission remains to be brought into full play, the relation between national natural resource supervision and the central supervision for the protection of ecological environment needs to be straightened out, the supervision enhancement is weak and the accountability system needs to be fleshed out. With regard to the above-mentioned issues, relevant policy options are raised as follows. The coherence between national laws and regulations and that of the Party should be strengthened so as to consolidate the legal basis for the rule of law; the inspection of environmental protection laws needs to be incorporated into the central ecological and environmental supervision; a mechanism for inspecting the performance of related central departments needs to be established; a special central supervision system for the protection of natural resources needs to be established or the supervision over natural resources is to be incorporated into the central supervision for the protection of ecological environment; the supervision over the sustainable and coordinated local economic development and environmental protection needs to be stressed out; the accountability for the leading officials working at city and county-level Party and government departments needs to be moderately increased.
