Two types of land expropriation in Taiwan and relevant implications (No 34, 2015)

Abstract:

In China's Taiwan province, general expropriation only applies to public welfare programs, taking the market land price as the benchmark to make compensations based on current government-declared value of land. Relevant preceding procedures and subsequent procedures relating to exceptional cases are made to fully protect the rights of those whose land is expropriated. Zone expropriation is used to implement specific economic policies focusing on cooperative land development between Taiwan authorities and local people and centered on compensation for expropriated land. With regard to general expropriation, it could directly and effectively get land for public facilities but with high cost. As for zone expropriation, its land distribution is free from the influence of original place and it is good for comprehensive development with little financial burden. It is suggested that we adopt both general expropriation and zone expropriation in China's land expropriation reform and carry out different expropriation plans according to different purposes and zones. We need to revise the previous compensation method and build a general expropriation compensation system based on government-declared value and formulate measures to implement zone expropriation.
